The personal data processed by us will be stored by us for as long as is necessary for the respective purpose – in particular the processing of your enquiry or order – in compliance with statutory retention periods. Storage beyond the statutory retention period is possible if you have consented to this, or if the purpose of the data processing continues to apply.

Your rights in relation to your personal data

You have the right to obtain information about the personal data we process about you (including a copy), and the right to rectification of your personal data. You also have the right to have your personal data deleted, and the right to object to the processing of your data.

To the extent permitted by law, we may therefore refuse your data protection requests (e.g. requests for information and deletion) or comply only partially. You do have the right, however, to lodge a complaint with a competent supervisory authority.

In particular, cookies make it possible to determine the frequency of use and the number of users of the sites and analyse behaviour patterns of site use, as well as to make our offering more customer-friendly. Third-party services

We use the Google services listed below on our website for various purposes. These services provided by the US company Google LLC use cookies to transfer data to Google in the USA. We assume that no personal tracking is carried out in this context solely through the use of our website. Google has undertaken to guarantee appropriate data protection in accordance with the EU-US and Swiss-US Privacy Shield. Further information can be found in Google’s privacy policy.

a) Google Tag Manager

Our website uses the Google Tag Manager (GTM) to download additional services. This means that Google is informed when a website is accessed using the IP address of your end device, and can also track which functions and tools are downloaded via the GTM.
You have the option of deactivating this service to stop data from being transferred to the provider by deactivating JavaScript in your browser settings. Please note however that in this case you may not be able to use all the functions of the website to their full extent.
More information about Google Tag Manager and the related data protection provisions can be found on the Google website.

b) Google reCAPTCHA

Our website uses the Google reCAPTCHA service, which protects websites from spam software and misuse by bots. When reCAPTCHA is used, data is transmitted to Google to confirm that you are actually human.

More information about Google reCAPTCHA and the related data protection provisions can be found on the Google website.
Processing of your data when using the contact form on this website:
We only collect the personal data you provide via the contact form or as part of any other contact with us. If certain fields are labelled as “mandatory”, they will be used to collect the data required to perform the action required.

Processing of your data when using the contact form on this website

We only collect the personal data you provide via the contact form or as part of any other contact with us. If certain fields are labelled as “mandatory”, they will be used to collect the data required to perform the action required.

Additional information for users of our social media accounts

We maintain company accounts on the following social media platforms:

  • Xing: New Work SE, Am Strandkai 1, 20457 Hamburg, Germany
  • LinkedIn: LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland

As the holder of an account on one of the social media platforms, we process personal data when you write to us directly via the platform (in a direct message or via the public comment function). The selection of data collected depends on the information and contact details you provide/release. This data is processed on the basis of pre-contractual measures, insofar as this is necessary for the performance of a measure requested by you. In all other cases, processing is based on our legitimate interest in the effective processing of the enquiries addressed to us.

When you visit a company account, the respective provider collects information that allows it to recognise users and perform a comprehensive analysis of user behaviour. The operator of the social media platform can also use the data collected in this way to create user profiles. If you are logged in with your own social media account when you visit a company account, the respective provider can also assign this visit to your account.

The provider concerned only provides us with an anonymised statistical evaluation of visits to our company account based on the information obtained. This enables us to make our social media usage even more effective, and means that we have a legitimate interest in the collection and processing of this information. We also have a legitimate interest in using as many communication channels as possible in order to reach as many interested parties as possible personally.

We do not pass on any of the personal data we collect via our company social media accounts to third parties.

Additional information for business partners and interested parties

In addition to our general information, here we provide information on how the personal data of our business partners and interested parties is collected, for what purpose it is processed and on what legal basis. We also provide information on the parties to whom data concerning our business partners and interested parties is disclosed, and for what purpose.

We process personal data that is necessary for the fulfilment of obligations in the context of a potential contract, and from contractual relationships with our business partners. This includes in particular first name, last name, valid e-mail address, postal address, telephone number (landline and/or mobile), company affiliation and function.
We may process personal data concerning our existing customers and interested parties in order to send information about our services (e.g. company and/or product information or event invitations). We have a legitimate interest in this activity. You can object to this processing at any time.

Our promotional activities may include physical mailings and/or electronic newsletters. A tracking pixel is used in the e-mail newsletter so that we can track whether you have opened it. Information on opening and click rates in particular is stored and processed, and the information obtained is used to make the newsletter even more attractive to you. You can revoke your consent to receive the newsletter at any time via the link provided for this purpose in every newsletter, or by sending a message to the contact details provided above. You can also object to the processing of your personal data for advertising purposes with effect for the future in writing, by e-mail or by telephone. The newsletter is dispatched by the service provider The Rocket Science Group, LLC, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308 USA, (“Mailchimp”).

Your personal data will only be disclosed to third parties if this is permitted by data protection law, in particular provided you have given your consent, the disclosure is necessary for the purpose of processing the contract, or if the legitimate interests described above are met.

Additional information for job applicants

In addition to our general information, we provide information here on how the personal data of job applicants is collected, and for what purposes and on what legal basis it is processed. We also provide information on when applicant data is deleted.

We treat the personal data you provide us with voluntarily as of the application process with particular caution, and only disclose it to authorised persons within Empiricon. This applies in particular your first and last name, postal address, e-mail address, date of birth, place of birth, profession, CV, references and special categories of personal data. Additional data relevant to the application may be collected during the application process, and this will also be stored and processed. Your personal data will only be processed for the purpose of the application procedure. If your application is successful, the data will be transferred to your personnel file for the purposes of the employment relationship.

If your application is unsuccessful, your personal data will be deleted no later than six months after the end of the application process, unless processing of your data is necessary for the assertion, exercise or defence of legal claims.

Your data will only be processed beyond a specific job application process if you have expressly consented to your data being stored in our database in general, or even after the end of a specific application process, so that we can contact you at a later date should a vacancy occur. If you no longer wish to be contacted by us, you can revoke your consent at any time with effect for the future in writing, by e-mail or by telephone. In all other events, we will delete your data after one year. Should renewed contact occur in connection with the establishment of an employment relationship, the storage period will be extended by six months.

Additional information for survey participants

In addition to our general information, we provide information here on how the personal data of participants in surveys conducted by Empiricon is collected, and for what purposes and on what legal basis it is processed.

In the case of surveys conducted by Empiricon on behalf of our clients (employee or customer surveys, for example), we process your personal data, which is usually provided by the client. The type and quantity of personal data transmitted and processed is contractually agreed between the client and Empiricon. The personal data includes the information necessary for conducting and evaluating the surveys (usually first name, last name, title/gender, e-mail address and details of organisational affiliation). The client retains responsibility for the personal data. Empiricon supports the client in fulfilling its obligations (concerning its duty to inform and data security, for example) and the rights of data subjects in accordance with the applicable data protection legislation and contractual arrangements.

By taking part in the survey, you consent to your responses being evaluated by Empiricon. Your rights are guaranteed during the period of the survey (right of access and right to rectification of data, for example).

The form and scope of the evaluation of responses following the end of the survey period (anonymity rules such as the minimum number of respondents required for a separate evaluation, for example) are determined in consultation with the client.

Empiricon processes your personal data solely for the purpose indicated in the information accompanying the relevant survey.

Your personal data will only be passed on to third parties after consultation with and with the consent of the client responsible.

Your personal data will be stored and deleted in accordance with the contractual arrangements made with the client.

Our data protection rules are based on current data protection legislation and the international ESOMAR code of practice.
